These terms govern your use of the Blue Rain Harbor website (“the site”). By using the site you accept them. If you do not accept them, please do not use the site.
1. What Blue Rain Harbor is, and is not
Blue Rain Harbor is an information and guidance service about 終活 (end-of-life planning) in Japan. We help people organise their thoughts and papers, prepare questions and talk with their families. We are not a law firm, tax or accounting firm, medical provider, financial adviser, insurance agent, funeral business or social-welfare service, and nothing on the site or in our conversations is legal, tax, medical, financial or funeral advice. This site does not claim any professional licence or qualification on our behalf.
2. Information on the site
Pages on the site are general information. They describe common situations in broad terms and may not apply to yours. Laws, procedures and deadlines concerning wills, inheritance, registration, tax, guardianship and care change, and the site may not reflect the latest changes. Before you rely on anything that has legal, tax or medical consequences, confirm it with the appropriate licensed professional or public office.
3. No contract through the website
The site has no online checkout or booking system. Sending a message through the form, or booking a conversation by email or phone, does not create a contract for paid services. The first conversation is free. If you wish to continue, we give you a written quotation setting out what is included and the fee, and the service begins only when you have accepted it in writing. Payment terms and cancellation terms are stated in the quotation. See the Commercial Notice.
4. Our services in practice
- We offer guidance sessions, written worksheets and help with preparing for conversations with family members and professionals.
- We do not draft wills or contracts, witness documents, file anything with a court, tax office or registry, act as a guardian or representative, mediate disputes, arrange funerals or graves, hold your money, documents or passwords, or recommend financial products.
- Where a step requires a licensed professional, we say so and leave it to them. We have no partnership with any named professional or firm, and if you hire one, that is a separate agreement between you and them.
5. No guarantee of outcomes
We cannot guarantee that following our guidance will lead to any legal, financial, tax or family outcome. Whether a document is valid, whether tax is payable, whether a family agrees and how a doctor or hospital acts depend on facts and rules that are outside our control.
6. What we ask of you
- Give us accurate information about yourself and what you want.
- Do not send passwords, account numbers, My Number or health information through the site or by email. We will tell you if we need something specific and how to provide it.
- Do not use the site unlawfully, interfere with its operation, or send messages that are abusive or misleading.
7. Third-party services and links
The site loads fonts from Google and sends form submissions through formsubmit.co, and it links to Google Maps. We do not control those services and are not responsible for their availability or practices. Please read the Privacy Policy for details.
8. Intellectual property
The text and design of the site belong to Blue Rain Harbor or its licensors. You may read and print pages for your own use. Please do not copy or republish substantial parts without asking us. Photographs on the site are stock images used to illustrate topics; they do not show our staff or clients.
9. Limits on our liability
We make reasonable efforts to keep the site accurate and available, but we do not warrant that it is complete, current or free of interruption. To the extent permitted by Japanese law, we are not liable for losses arising from your reliance on the general information on the site. This does not limit liability that cannot be limited by law, including liability for intentional or grossly negligent acts, and it does not affect any rights you have as a consumer.
10. Changes to the site and to these terms
We may change or withdraw parts of the site and may update these terms. The date at the top shows the latest version. Using the site after a change means you accept the updated terms.
11. Governing law
These terms are governed by the laws of Japan. If a dispute arises that cannot be settled by discussion, the Kumamoto District Court (熊本地方裁判所) or the Kumamoto Summary Court (熊本簡易裁判所) may serve as a court of first instance, to the extent the law allows.
